Shergroup knows that the threat of removing certain items makes the "Won't Pay" debtors take notice. Its powers of enforcement are very real when it threatens to take those all-important status symbol items away.
Shergroup chief executive, Claire Sandbrook, said: “Judgment creditors will be pleased to know that threats of having those high-value items seized can encourage almost immediate payment.
“The fact is that a debtor can't keep the plasma TV screen and still expect to keep their creditor waiting.”
Making the debtor understand their responsibilities is key: “Of course protection is offered through the National Standards for Enforcement Officers and the Civil Procedure Rules to protect the debtor and the family, but at the same time people need to appreciate that those who can pay should make every effort to do so,” added Mrs Sandbrook.
Shregroup’s job as High Court Enforcement Officers (HCEOs) is to ensure it acts with high standards when advising certain debtors they need to recognise they can't keep the status symbols of wealth when they owe money.
Mrs Sandbrook said: “If someone allows us into the home there are obvious day-to-day items they need to keep and other items that may have to go.
“The plasma TV screen is just one of those items and homes today often have more than one TV, so the plasma TV screen gets classed as a luxury item.
“We found in executing a Writ on a modest semi-detached house that despite a K-reg Range Rover on the drive, it was actually the threat of removal and sale of the plasma TV that made the debtor reach for his wife's purse to pay the debt.”
Another satisfied Sherforce client had their debt paid in full with no removal costs being incurred by the debtor. As Mrs Sandbrook says: “It’s not always necessary to remove, it's the threat of removal that can make all the difference.”
