How a Warning Notice works

For our regular users you will often see in the Enforcement Officer's initial reports that the officer was not able to gain access to the house and a Warning Notice was left.

These notices are designed to provoke the debtor into making contact with the officer and this picture shows the notice being posted through the front door of a debtor who wouldn´t open the door.


Cars were parked outside so they were seized and the vehicle registration numbers sent to the DVLA to be checked. One came back showing the people carrier was registered to the judgment debtor, but it was on finance.

We rang the finance company to seek their agreement to allow us to remove and sell the vehicle to release the debtor's interest in any available equity.

Unfortunately, despite the willingness of the finance company to talk to us we found the outstanding balance on the finance agreement was £5,000 with the vehicle valued at only £3,000.

We agreed that the car was best left where it was so the next option was to try to enter the property with the debtor's agreement.

We left the Warning Notice and although the debtor didn't come to the door and invite us in, he did call the Enforcement Officer the next day and offered to pay £350 a month on a debt valued at just over £3,000.

It´s not the ideal result, but better than nothing and bearing in mind there were no other available goods and we couldn't gain entry to the property our client was pleased with the result.
